Tracfin is an administrative investigation department, which receives a suspicious transaction report from a financial institution subject to the anti-money laundering provisions. It acts by exchanging information with government departments, in particular theOffice central de répression de la grande délinquance financière, theAutorité de contrôle prudentiel, theAutorité des marchés financiers and with local authorities; it also exercises a right of communication with all entities subject to the legislation. At the end of its investigation, a presumption of suspicion may be transmitted to the judicial authorities, pursuant to article 40 of the Code of CriminalProcedure1.

Tracfin contributes to the growing concern to combat money laundering and develop a healthy economy. The legislator has entrusted it with three main missions:

  • to receive and protect information on clandestine financial circuits and transactions that could be used to finance terrorism or launder illegal funds (articles L.521-23 and R.561-33 of the CMF);
  • analysis and enhancement of financial information received under Articles L.561-26, L561-27 and L.561-31 of the CMF;
  • transmitting financial intelligence (Article 561-29 of the CMF) to the judicial authorities, criminal investigation departments, government departments and specialised intelligence services.

Tracfin's role is to collect, analyse and add to the reports submitted by regulated professionals.
